These Terms of Service ("Terms") govern your use of websites and services operated by Xeal Publishing LLC ("Company," "we," "us"), including xeal.net and related agency services offered under the brand Xeal.
By using our websites or purchasing services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the sites or services.

2. Services
We provide digital strategy, SEO and GEO, websites, publicity, automation, voice AI, AI systems, consulting, and related services. Service descriptions on the website are general. Specific deliverables, fees, timelines, and responsibilities are set in a separate statement of work, order form, product checkout terms, or written agreement.
Service packages, retainers, and project scopes are defined in a separate proposal, statement of work, or order form. Public pages do not list fixed retail prices; engagements are quoted.
3. Website use
- Content on our sites is for general information and business education unless we enter a paid engagement with you.
- You may not misuse the sites, attempt unauthorized access, scrape in a way that harms service, or use the sites for unlawful purposes.
- We may change or discontinue site features at any time.
4. Accounts, demos, and tools
Interactive demos, coaches, booking widgets, and similar tools are provided "as available." Demo tools are illustrations of capability and may not include your full production configuration, compliance rules, or data protections until implemented under a separate agreement.
5. Fees, payment, cancellation
- Fees depend on scope and are stated in your proposal, order, or checkout flow.
- Unless otherwise agreed in writing, services may be month-to-month or prepaid product terms.
- Where a cancellation right applies, clients typically must provide at least 30 days' written notice. Setup fees and work already performed are generally non-refundable unless required by law or a separate written refund policy.
- Payments are processed through third-party processors as indicated at checkout.
6. No professional advice guarantees
Unless expressly stated in a signed agreement, we are not your attorney, accountant, financial advisor, or employee. Marketing, SEO, AI, and automation outcomes depend on many factors outside our control. We do not guarantee specific rankings, revenue, AI recommendations, call volumes, or business results.
7. SMS and communications
If you opt into SMS or other messaging from Xeal Publishing LLC (Xeal), message terms in our Privacy Policy apply, including STOP to cancel, HELP for help, variable message frequency, and message and data rates. Consent to marketing texts is not a condition of purchase. You agree that we may contact you using the contact details you provide for service delivery and, where consented, for marketing.
8. Intellectual property
Site content, trademarks, designs, software, and materials we create remain owned by Xeal Publishing LLC or our licensors unless a written agreement assigns rights to you. Client materials you provide remain yours. You grant us a limited license to use client materials as needed to perform services.
9. Confidentiality
Each party should protect the other's non-public business information shared for the engagement and not disclose it except to personnel and providers who need it to perform, or as required by law.
10. Third-party services
Our work may integrate third-party platforms (hosting, CRM, SMS, voice carriers, AI model providers, analytics, ad platforms). Those services have their own terms and policies. We are not responsible for outages, policy changes, or acts of third parties outside our reasonable control.
11. Disclaimers
SITES AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of liability
To the maximum extent permitted by law, Xeal Publishing LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, data, or business opportunities. Our total liability for any claim related to the sites or services is limited to the fees you paid us for the specific service giving rise to the claim in the three months before the claim, except where liability cannot be limited by law.
13. Indemnification
You agree to indemnify and hold Xeal Publishing LLC harmless from claims arising out of your misuse of the services, your content, your failure to obtain required consents for messaging or marketing, or your violation of these Terms or law, except to the extent caused by our proven gross negligence or willful misconduct.
14. Termination
You may stop using the websites at any time. Either party may terminate a service engagement as allowed in the applicable order or agreement. We may suspend or terminate access for misuse, non-payment, or legal risk.
15. Changes
We may update these Terms by posting a revised version with a new effective date. Continued use after changes constitutes acceptance of the updated Terms for website use. Paid engagements remain governed by their signed agreements unless those agreements allow updates by notice.
16. Governing law and disputes
These Terms are governed by the laws of the United States and the state where Xeal Publishing LLC principally administers its contracts, without regard to conflict-of-law rules. Before filing a lawsuit, the parties will attempt good-faith resolution. Where arbitration is required by a separate signed agreement, that agreement controls.
